Consider/Approve Amendment to Board Policy #1.108 – Nepotism


Background Information:

During the latest legislative session, Public Chapter No. 301 was signed into law effective July 1, 2013. The Board has a policy addressing nepotism when it comes to the hiring of relatives of a board member, an elected or appointed county official, the director, an administrator, and/or a county commissioner. The Board’s current policy simply requires public notice of the relationship prior to employment. The new law not only requires notice prior to employment, it also requires board members to declare the relationship prior to any vote which may impact relatives and provides that if two (2) or more employees are relatives within the same direct line of supervision, then the director shall attempt to resolve the conflict by transfer or development of an alternate evaluation plan. Additionally, the term “relative” has been expanded to include nieces, nephews, and any person who resides in the same household. To this end, TSBA has developed a sample policy for the Board’s consideration, and it is recommended to be adopted in totality.

Staff Recommendation:

Due to the amendment reflecting current state law, I recommend approval of the above-noted amendment to Board Policy #1.108 – Nepotism, on first and final reading.
